Terms and Conditions (Rentals)

1. General

1.1 Applicability

1.1.1 These Terms & Conditions apply exclusively to Rental Agreements.
1.1.2 Tour packages are subject to separate terms and conditions outlined by Lemonrock, LLC and will be presented to you with your tour package/proposal.

1.2 Business Information

1.3 Contract with Lemonrock

1.3.1 By entering into this contract, you (“Customer”) agree to these Terms and Conditions, forming a binding agreement with Ireland Rider Motorcycle Rental Ltd t/a Lemonrock Motorcycle Tours (“Lemonrock”) and Lemonrock, LLC.

1.4 Acceptance of Terms

1.4.1 Acceptance can occur through:
a. In writing
b. By email
c. By electronic signature
d. By payment of a deposit
e. By ticking the Terms & Conditions checkbox on our website

1.5 Changes and Updates

1.5.1 These terms are subject to change and may be updated before the tour or rental commences.
1.5.2 Updated terms will be displayed at https://www.ridelemonrock.com.

1.6 Hours of Business

1.6.1 Operating hours: 09:00 to 17:00, Monday to Friday.
1.6.2 Weekend openings may be arranged with prior agreement.

1.7 Party Leader

1.7.1 The party leader must:
a. Be at least 25 years old.
b. Be authorized to make the booking.

1.7.2 For members under 18, authorization must come from their parent or guardian.
1.7.3 By paying the deposit, the party leader accepts these Terms & Conditions on behalf of all party members.

1.8 Verbal Changes

1.8.1 Verbal changes are invalid unless confirmed in writing by Lemonrock.

1.9 Severability

1.9.1 Invalidating one part of these Terms & Conditions does not affect the validity of the remaining contract.

2. Photographic Material and Personal Information

2.1 Photographic Material

2.1.1 Photographic material produced by Lemonrock remains its property.
2.1.2 Lemonrock may use this material for marketing purposes without compensating the Customer.

2.2 Personal Information

2.2.1 Customer information may be retained and used to fulfill the contract (e.g., for hotel bookings).
2.2.2 Information may be shared with statutory authorities when necessary.
2.2.3 Customer details will not be shared with third parties without prior consent.

3. Customer Responsibilities

3.1 Compliance with Regulations

3.1.1 The Customer must adhere to all passport, visa, driving, and health regulations.

3.2 Travel Insurance

3.2.1 Valid travel insurance is strongly recommended.

3.3 Traffic Laws

3.3.1 Compliance with national traffic laws is mandatory.

3.4 Helmet Use

3.4.1 Approved motorcycle helmets must be worn at all times.
3.4.2 Customers can rent helmets or use their own, provided they meet Irish legal standards.

3.5 License and Competence

3.5.1 The Customer confirms they hold a valid motorcycle license from an approved country/state.
3.5.2 The Customer must have the necessary competence to operate the rental motorcycle.

3.6 Safe Riding

3.6.1 Lemonrock encourages safe and sensible riding practices.

4. Cancellations, Refunds, and Re-Bookings

4.1 Refund Policy

4.1.1 No refunds will be issued after the rental or tour has commenced.

4.2 Rental Refusals

4.2.1 Lemonrock reserves the right to refuse rentals if the Customer:
a. Does not sign the Rental Terms & Conditions.
b. Fails to provide a valid driving license.
c. Fails to authorize their credit card for the deposit/charges.

4.3 Termination of Agreement

4.3.1 Lemonrock may terminate the agreement without notice for:
a. Non-compliance with responsibilities.
b. Breach of insurance or contract terms.
c. Motorcycle misuse (e.g., burnouts, wheelies).
d. Damage rendering the motorcycle unsafe.

4.4 Fees for Termination

4.4.1 Upon termination, the motorcycle must be returned immediately.
4.4.2 Charges include a €350 recovery fee, €50 termination fee, and applicable repair costs.

4.5 Deposit and Refund Terms

4.5.1 Deposit: 30% due at booking; final balance due 7 days before pick-up.
4.5.2 Refund Policy:
a. 90+ days prior: Deposit non-refundable; other payments refundable.
b. 60–89 days prior: 30% of total cost or deposit (whichever is greater) non-refundable.
c. 15–59 days prior: 50% of total cost non-refundable.
d. 0–14 days prior: 100% of total cost non-refundable.

4.5.3 No refunds for early returns or incomplete rentals.

5. Force Majeure

5.1 Circumstances Beyond Control

5.1.1 Lemonrock is not liable for events including:
a. War, civil unrest, or terrorism.
b. Industrial disputes.
c. Transport issues.
d. Natural disasters.

5.2 Liability

5.2.1 No refunds or compensation will be provided for cancellations due to force majeure.

6. Personal Injury

6.1 Liability

6.1.1 Lemonrock is not liable for personal injury, death, or illness.

6.2 Rider Competence

6.2.1 Customers must have the competency and experience required to operate the motorcycle.

6.3 Guided Tours

6.3.1 Participants must ride at their own pace and not exceed their capabilities.

6.4 Risk Acknowledgment

6.4.1 Riders participate entirely at their own risk.

6.5 Financial Loss

6.5.1 Lemonrock’s liability for financial loss is limited to the contract price.

7. Motorcycle Reservation and Security Deposit

7.1 Reservation Requirements

7.1.1 A 30% deposit is required to secure a reservation.

7.2 Model Substitution

7.2.1 Motorcycle models are subject to substitution.
7.2.2 Comparable replacements will be provided where possible, or a full refund offered.

7.3 Security Deposit and Damage Costs

7.3.1 Customers are responsible for damage/theft up to €2,500 (reducible with CDW).
7.3.2 A valid credit or debit card is required for the pre-authorized damage deposit.
7.3.3 Lemonrock reserves the right to deduct repair costs and reauthorize charges for rentals exceeding 7 days.

7.4 Damage Refunds

7.4.1 In the event of damage, the remaining deposit will be refunded after deducting repair costs.

7.5 Customer Payment Obligations

7.5.1 The Customer agrees to pay for:
a. Rental and additional agreed charges.
b. Loss/damage resulting from failure to meet responsibilities.
c. Fines related to traffic or parking violations.
d. Legal fees incurred by Lemonrock due to Customer actions.

7.6 Theft

7.6.1 In the case of theft, the motorcycle keys must be returned to Lemonrock.

7.7 Rider Liability

7.7.1 Liability is limited to the waiver levels, provided the rider has:
a. Supplied accurate information.
b. Adhered to the Irish Road Traffic Act.
c. Complied with rental conditions.

8. Motorcycle Handover, Rider Requirements, and Restrictions

8.1 Inspection and Fuel Requirements

8.1.1 The motorcycle’s condition will be inspected at pick-up.
8.1.2 The motorcycle must be returned with a full tank of fuel.
8.1.3 Customers must ensure they use the correct fuel and engine oil for the motorcycle.
8.1.4 Damage due to incorrect fueling or engine oil use is the Customer’s responsibility and is not covered under the Collision Damage Waiver (CDW).

8.2 Tyre Responsibilities

8.2.1 Tyre punctures are the Customer’s responsibility.
8.2.2 Any tyre replacement costs, including labor, will be charged to the Customer.

8.3 Rider Requirements

8.3.1 Riders must meet the following criteria:
a. Be aged 25–70 years.
b. Hold a valid motorcycle license from an approved country/state.
c. Have ridden at least 3,000 km in the past two years on a similar motorcycle.
d. Be at least 30 years old to carry a passenger.

If you do not meet, these requirements you may complete an insurance exception application.

8.4 Assessment of Fitness

8.4.1 Lemonrock reserves the right to assess whether the Customer is fit to operate the rental motorcycle.
8.4.2 Assessment includes, but is not limited to:
a. Adequate riding experience and competence.
b. Compliance with all licensing and legal requirements.
c. Physical and mental fitness to operate safely.
d. Adherence to Lemonrock’s safety and operational guidelines.

8.5 Right to Refuse Rental

8.5.1 Lemonrock reserves the right to refuse rental if the Customer is deemed unfit to operate the motorcycle.
8.5.2 Grounds for refusal include:
a. Lack of sufficient riding experience.
b. Behavior indicating inability to operate the motorcycle safely.
c. Violation of traffic laws or safety requirements.
d. Evidence of impairment (alcohol, drugs, or other substances).

8.6 No Refund for Unfitness

8.6.1 No refunds will be issued if the Customer is deemed unfit to operate the rental motorcycle.

8.7 Riding Restrictions

8.7.1 The motorcycle must not be used for:
a. Illegal purposes.
b. Commuting or commercial use.
c. Racing, teaching, or off-road riding.
d. Driving under the influence of alcohol or drugs.

8.8 Driver Exclusions

8.8.1 Drivers with the following are excluded:
a. Driving bans within the past 5 years.
b. Multiple driving offenses or insurance claims.
c. Criminal convictions or insurance cancellations.

9. Theft, Accidents, and Breakdown

9.1 Theft or Damage

9.1.1 Customers must use the provided security lock whenever parking the motorcycle.
9.1.2 In case of theft or damage, notify Lemonrock immediately.

9.2 Accident Reporting

9.2.1 In case of an accident, the Customer must:
a. Not admit responsibility.
b. Obtain information from involved parties and witnesses.
c. Take photographs of the scene.
d. Notify the police if necessary.
e. Cooperate with Lemonrock and its insurers.
f. Inform Lemonrock within 24 hours and submit an accident report.

9.3 Replacement Motorcycles

9.3.1 When possible, Lemonrock will provide a replacement motorcycle for breakdowns not caused by the Customer. 
9.3.2 No replacement will be provided for accidents or Customer-caused breakdowns.

9.4 Breakdown Reporting

9.4.1 In case of a breakdown, notify Lemonrock within 24 hours.
9.4.2 If recovery or replacement is required, a recovery fee of €350 will apply or be retained from the security deposit.

10. Additional Services and Jurisdiction

10.1 Rental Equipment

10.1.1 Lemonrock provides rental equipment, including navigation systems, luggage, riding gear/equipment, and helmets.
10.1.2 Missing or damaged equipment will incur replacement charges.

10.2 Rental Location

10.2.1 Rentals start and finish at Lemonrock’s Baldoyle location.

10.3 Jurisdiction

10.3.1 These Terms and Conditions are governed by Irish law.
10.3.2 Any disputes will be subject to the exclusive jurisdiction of Irish Courts.
